Continuing Care

Idaho’s Continuing Care Disclosure Act (“Act”) regulates entities that offer to provide long-term care and lodging after payment of an advance fee often called an “entrance fee.”  In 1988, the Idaho legislature adopted the Act in response to tragic consequences incurred by Idaho citizens when a provider became insolvent due to embezzlement and mismanagement.  The primary tenants of the statute focus on the importance of full disclosure to prospective Idaho consumers with respect to the terms of the providers’ agreements and operations.
